The term "website" means the Intarra website PLUS the entire Intarra platform which includes all processes, media, IT hardware and tools used in conjunction with the website to manage the same and to collect, publish, display, distribute, monitor, manage and curate event information. It also specifically includes hardware used to scan QR codes. By way of example only hardware used to scan QR codes includes those provided to businesses which allow them to scan InTarra Community Cards and Free InTarra Gift Vouchers.

SPECIAL TERMS REGARDING SIGN UP

You understand that you will be given a Membership ID and it will APPEAR PUBLICLY IN EACH EVENT YOU ENTER INTO THE CALENDAR. You give permission to disclose to the organisation running the event, your Membership ID and all the details you have entered in the Sign Up Form, excluding your password and mobile phone number. Your Membership ID will not include any of your personal details. For example, a Membership ID might look as follows: 'AZT0002'

You understand that if you use an InTarra POS terminal, for example to claim a voucher or collect points in an InTarra points program, your First Name and/or Last Name, as they were entered during Sign Up, may be displayed on the POS terminal and may be visible to anyone in the vicinity.

Website owner, the offering, and binding of Terms

This website is owned and operated as a free community service by Arrayware Pty Ltd. ACN: 063 989 800. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors information about events and activities taking place in the community. This website also offers members the ability to enter information (Create Content) about events taking place in the community. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

Who can use the website; what are the requirements to create an account

In order to use our website and/or receive our services, you must be at least 12 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Key commercial Terms

This website operates as a free community service. It provides a medium and platform via which members may enter information about events in the community. As such this website does not offer product for sale nor does it guarantee or warrant the information available on it in any way.

Special Terms for Business / Commercial users (updated 22 November, 2020)

Business users are encouraged to add calendar entries but they must be genuine community 'happenings' in the spirit of a community calendar. The calendar must not be used to simply advertise or publicise the main activity of the business. Examples below are given to assist. The interpretation of 'in the spirit of a community calendar' will be made solely by the InTarra administrators. Illustrative examples: A golf club cannot add 'golf this week' but can add special golf workshops of a non-regular nature or notice of visiting celebrity golfer; A cafe cannot add its 'weekly specials' but can add 'live music events'; A country club cannot add 'special pokies night' because that is a main business activity. A new business or business that has been closed for an extended period can place an 'Opening Week' entry in the calendar. There are exceptions to these terms for community groups, not for profits, newsletters and community-related media.

Return and refund policy

Retention of right to change offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Warranties & responsibility for services and products

The information and site content have been created by site members and no guarantee or warranty is given with respect to the information and content.

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Arrayware Pty Ltd. ACN: 063 989 800. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Uploading and Creating Content

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works)(Content) through any means to the website, you confirm and warrant that you own all the relevant rights or received the appropriate license to upload/transfer/send the Content. You agree and consent that the uploaded/transferred Content may be publicly displayed at the website and on public electronic displays in the community and sent via email, mail or other information transfer service to any interested person. Further: You warrant that you have permission to enter information on behalf of the Organisation that you nominate upon Sign Up as a member and any other Organisations that you nominate as being a Calendar Representative thereof.

Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

Indemnification

You agree to indemnify and hold Arrayware Pty Ltd. harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Arrayware Pty Ltd be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Arrayware Pty Ltd assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, or email. If you don't want to receive such promotional materials or notices – please just notify us at any time.

Gifts, Giveaways, Prizes

We may from time to time give away free gifts to members. Gifts are given at our sole discretion.

Any game of skill run by us will have written criteria available to members. The decision of winners of any game of skill will be made solely by us at our discretion and no correspondence or discussion will be entered into.

Community Points Program / Community Benefits Program (Effective 1 January 2021)

When running, the program works generally as follows: InTarra Members collect points at local participating retailers by using their InTarra Mobile App or membership card. Members choose a club, school or other local not-for-profit group who will receive these points (the Beneficiary). The Beneficiary will later be awarded cash based on the points they have accrued and other parameters.

There is a points limit of 3000 points per member per month. Any points accrued in excess of this will not be added to the points tally.

Participation in the program as a Beneficiary is free but requires the Beneficiary to uphold all terms at all times to be eligible.

The Administration of InTarra may, at its sole discretion, disqualify a Beneficiary from the program or disallow its participation in the program at any time with or without cause. It may therefore disallow any organisation of any kind from participating in the program based on the organisation's size, nature or any factor whatsoever.

The formula, method and parameters used for calculating the cash value of each point is at the sole discretion of the InTarra Administration. The formula, method and parameters used may change at any time without notice and may be different for each Beneficiary.

In addition to points collected from participating retailers, InTarra may award points to Beneficiaries and to Members at any time at its sole discretion.

InTarra is a community service project administered on a volunteer basis. It is possible that technical issues or oversight may result in system errors and errors in the points system. InTarra Members and Beneficiaries accept that the system is not perfect and AGREE THAT INTARRA WILL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER CAUSED BY FAILURES OR ERRORS. Any determination as the the points balance of any Member or Beneficiary will be made solely at the discretion of InTarra.

The Beneficiary will actively promote the InTarra Points Program to its own members / constituents and encourage them to collect points for the Beneficiary by shopping locally.

While the Beneficiary takes part in the program, it commits to listing all its activities, which are open to the public, on the InTarrra Calendar no later than the same day they are listed on its website or on social media.

The Beneficiary agrees to its points balance and the amount of cash paid to it based on its points balance may be made public at any time.

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws Victoria Australia without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Victoria Australia. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

This Policy applies to all users of any part of the InTarra Platform including users of the website, Beneficiaries of the Community Points Program and Vendors and/or Retailers that offer points to InTarra Members via the InTarra Communith Points Program and/or offer free gifts to InTarra Members via the InTarra Gift Program.

What type of information do you collect?

We receive, collect and store any information you enter on our website or provide us or collect for us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page, shopping transaction information collected by any part of the InTarra Platform. We also collect personally identifiable information (including name, email, password, communications); comments, feedback, product reviews, recommendations, and personal profile. How do you collect information?

When you conduct a transaction using InTarra hardware (for example InTarra POS Machines used for the Community Points Program) or create content on our website, as part of the process, we collect personal information you give us such as your name, address and email address, transaction details. Your personal information will be used for the specific reasons stated in these terms and conditions and privacy statement only.

Why do you collect such personal information?

We collect such Non-personal and Personal Information for the following purposes:

To provide and operate the Services;

To provide our Users with ongoing customer assistance and technical support;

To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services. Our business partners include Vendors and/or Retailers that use and operate the InTarra POS Machines.;

To comply with any applicable laws and regulations.

How do you store, use, share and disclose your site visitors' personal information?

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you or to offer them for free. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

Other than exceptions specifically stated in the Terms and Conditions, we do not share any of your Personally Identifiable Information with anyone.

We may, for example, tell a retailer how many points claims and/or voucher claims were made in their store using an InTarra POS Machine but any data will be anonimised and relate to transactions in their store only.

We may, for example tell a sponsor, how many points claims and/or voucher claims were made using the InTarra POS Machines but all data will be anonimised and provide no information relating to any specific vendor, specific retailer or specific user.

How do you communicate with your site visitors?

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.
